The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on December 5, 2006 with the following members present: Edwin H. Humphrey, Ken Tracy and Mary Makley Wolff.
MRS. WOLFF made a motion to adopt the following Resolution:
RESOLUTION AMENDING THE TOWNSHIP'S PERSONNEL POLICIES AND PROCEDURES, DISPENSING WITH THE SECOND READING
WHEREAS, the Board of Trustees of Miami Township, Clermont County, Ohio (Board) has previously adopted personnel policies and procedures for non-union employees; and
WHEREAS, the Board desires to amend its personnel policies and procedures to eliminate a specific provision in the Training section.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio by authority of Chapter 504 of the Ohio Revised Code, as follows:
SECTION 1: That the Board hereby amends the Training section as referenced in Exhibit A attached hereto.
SECTION 2: The Board does hereby dispense with the requirement that this Resolution be read on two separate days, pursuant to Section 504.10 of the Ohio Revised Code, and authorizes the adoption of this Resolution upon its first reading.
SECTION 3: That this Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board and of its Committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.
SECTION 4: This Resolution shall take effect at the earliest period allowed by law.

EXHIBIT A
TRAINING
To facilitate employee advancement, the Township Administrator shall:
1) Assist Department Heads in developing and conducting training to meet the specific needs of their department and in developing and utilizing other techniques for increasing workers efficiency and effectiveness;
2) Develop, conduct, and/or send workers to supervisory and management training and other types of training and development programs common to all departments;
3) Assist Department Heads in establishing standards of performance and procedures for evaluating worker effectiveness;
4) Keep a record of all approved training programs and courses and a record of personnel who successfully complete such courses and programs.
The Department Heads shall work in concert with the Township Administrator to perform the above tasks.
The employer recognizes the benefits of continued education and training for professional growth and development. Therefore, full-time employees are encouraged to pursue their knowledge and participate in their formal education efforts. In order to assist the employee, the employer will provide the participating employee with tuition assistance as follows:
1) The employee will submit a written request to their Department Head or his designee and the Township Administrator prior to the start of the course for which reimbursement is sought. Requests for reimbursement will not be unreasonably denied upon proof of successful completion of course(s).
2) The course must be related to the employee's job responsibilities or be a required course leading to a formal degree from an accredited academic institution in the employee's job related field or other areas that will benefit the Township.
3) The employee will pay all initial fees, including books and will submit proof of attendance or completion except as noted in this section. The employee must maintain a minimum of a 2.0/C grade point average on a 4.0/A grading scale where applicable. In the event of a pass/fail grading system, the employee must maintain a passing grade.
4) Employee must have completed one (1) year of full-time service with Miami Township to qualify for tuition reimbursement.
The maximum reimbursement possible for a degree program will be:
90% for an A grade
80% for a B grade or Pass in a Pass/Fail course
70% for a C grade
The maximum amount of reimbursement is based on the in-state tuition charged by the University of Cincinnati, Main Campus, as of December 1 of each year. Upon reasonable proof of such expense, the employer shall reimburse an employee up to 50% of the cost of books for course work not to exceed $30.00 per course.
The employer will pay for all courses as required by the Township and/or the State of Ohio as a requisite to maintain a professional license/certificate or to maintain or advance in employment. These courses are either prepaid or reimbursed at one hundred percent (100%). Employees who are permitted to assess out of a course and who are charged a fee shall have fifty percent (50%) of said fee reimbursed by the employer.
Employees receiving tuition reimbursement under this policy must excute a re-payment agreement. Employees repay the Township by remaining continuously employed with the Township for two (2) years after the date from any tuition reimbursement check. The employee's obligation shall be discharged on a prorated basis. Employees on approved, unpaid leave will not receive reimbursement credit for the time spent in that status. The repayment obligation is discharged based upon the total reimbursement amount expended by the Township divided by twenty-four (24) months. An employee who voluntarily separates from Township employment prior to discharging this obligation shall have remaining debt deducted from their final Township paycheck.
All employees receiving tuition reimbursement under this policy are required to report their current student status in an annual report to their Department Head. The report will be in the form of a written memo addressed to their Department Head and will be due on or before December 15. The report will contain the following: courses completed during the current year; courses planned for enrollment in the up-coming year (listed by quarter/semester); and a short summary statement of the employee's progress towards degree completion.
A full-time employee who has received a degree from an accredited college or university in their related field (the Township Administrator will decide if the degree meets the incentive criteria) or public administration shall be entitled to an educational incentive bonus as follows:
Associate Degree - 2% of base pay
Baccalaureate Degree - 3% of base pay
Masters Degree - 4% of base pay
Doctorate Degree - 5% of base pay
Payments shall be made on the base rate of the employee during the first pay period of December.
