The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on December 7, 2004 with the following members present: Edwin H. Humphrey, Joseph W. Uecker and Mary Makley Wolff.
MRS. WOLFF made a motion to adopt the following Resolution:
RESOLUTION DECLARING THE PENSION PICK-UP FOR MEMBERS OF THE OHIO POLICE AND FIRE
PENSION FUND PURSUANT TO OHIO ADMINISTRATIVE CODE SECTION 742-7-14(B),
DISPENSING WITH THE SECOND READING
WHEREAS, the eligible employees of the Miami Township Fire and EMS Department
participate on the Ohio Police and Fire Pension Fund ("OP&F"), and
WHEREAS, the Board of Trustees of Miami Township, Clermont County, Ohio
("Board of Trustees") desires to pick-up zero (0%) percent of the ten
percent (10%) mandatory contributions required under Section 742.32 of the Ohio
Revised Code for participating employees of the Miami Township Fire and EMS
Department who are member of the OP& F; and
WHEREAS, OP&F has adopted new procedures for reporting picked-up contributions in order to properly prepare 1099-R forms for its members pursuant to Section 742.32 of the Ohio Revised Code and Section 742-7-14 of the Ohio Administrative Code; and
WHEREAS, the Board of Trustees wishes to reaffirm and amend and restate its prior resolution in order to continue the pick-up under the new procedures.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio by authority of Chapter 504 and Section 742.32 of the Ohio Revised Code, as follows:
SECTION 1: That effective immediately, the Board of Trustees has determined
to continue the pick-up zero (0%) percent of the ten percent (10%) mandatory
contributions by employees who are members of the Ohio Police and Fire Pension
Fund through a payroll reduction.
SECTION 2: That said picked up contributions, if any, paid through a payroll
deduction even though designated as employee contributions for state law
purposes, are being paid by the Board of Trustees in lieu of said contributions
by the employee.
SECTION 3: That the picked up treatment, if any, does not apply to contributions earned prior to the later of the date the Resolution is signed or effective.
SECTION 4: That said employee shall not be entitled to any option of choosing to receive the contributed amounts directly instead of having them paid by the Board of Trustees to the Ohio Police and Fire Pension Fund.
SECTION 5: The Board does hereby dispense with the requirement that this Resolution be read on two separate days, pursuant to Section 504.10 of the Ohio Revised Code, and authorizes the adoption of this Resolution upon its first reading.
SECTION 6: That this Board hereby finds and determines that all formal
actions relative to the passage of this Resolution were taken in an open meeting
of this Board, and that all deliberations of this Board and of its Committees,
if any, which resulted in formal action, were taken in meetings open to the
public, in full compliance with applicable legal requirements, including Section
121.22 of the Ohio Revised Code.
SECTION 7: This Resolution shall take effect at the earliest period allowed by
law.

Effective: January 6, 2005
