RESOLUTION 2003 - 17

The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session on April 1, 2003 with the following members present: Mary Makley Wolff, Edwin H. Humphrey and Joseph W. Uecker.

MR. HUMPHREY made a motion to adopt the following Resolution:

RESOLUTION OF SUPPORT FOR THE MIAMI TOWNSHIP 2003 CLEAN OHIO CONSERVATION FUND APPLICATION FOR FINANCIAL ASSISTANCE, DISPENSING WITH THE SECOND READING

WHEREAS, the State of Ohio, through the Ohio Public Works Commission, administers financial assistance for eligible projects through the Clean Ohio Conservation Fund; and

WHEREAS, the Miami Township Board of Trustees (herein "Board") has identified a land acquisition project that is eligible for Clean Ohio Conservation Fund financial assistance; and

WHEREAS, the project involves the acquisition of 1.6 acres along the Little Miami River to be used to provide river access from the Miami Township Riverview Park

NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio by authority of Chapter 504 and Chapter 164 of the Ohio Revised Code, as follows:

SECTION 1: That the Board supports the application for financial assistance through the Clean Ohio Conservation Fund.

SECTION 2: That David D. Duckworth, Miami Township Administrator, is hereby authorized and directed to execute and file an application for financial assistance and to provide all information and documentation required to become eligible for possible funding assistance.

SECTION 3: That this Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board and of its Committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.

SECTION 4: The Board does hereby dispense with the requirement that this Resolution be read on two separate days, pursuant to Section 504.10 of the Ohio Revised Code, and authorizes the adoption of this Resolution upon its first reading.

SECTION 5: This Resolution shall take effect at the earliest period allowed by law.

First Reading: April 1, 2003
Second Reading: Dispensed with
Effective: April 31, 2003

MR. UECKER seconded the motion to adopt the Resolution. On the roll call being called the vote resulted as follows:
