Decisions - 2008

 

 

The Miami Township Board of Zoning Appeals met on Monday, June 2, 2008 to consider and took action on the following cases: 

[Case 802]  Conrad Oppt, 353 Mill Street.  The applicant requested a variance to decrease the side yard setback
                  10 feet to 7 feet for an addition to the existing house.  After some discussion relating to hardship and 
                  zoning policy the Board voted to deny the variance request.

 Case 803]  Michael Crocker, 5290 Sugar Camp.  The applicant requested a variance to decrease the front yard setback
                  50 feet to 42 feet for an addition to the existing house.  After some discussion relating to hardship the hillside
                  to the rear of the house and the proposed deck, the Board voted to approve a setback variance for the 
                  proposed garage addition and required that the deck not extend any further into the front yard setback
                  than it currently does.

[Case 804]  Thomas O'Donnell, 958 Paxton Lake Drive.  The applicant requested a variance to decrease the rear yard
                  setback 15 feet to 5 feet for an addition of an in-ground pool..  After some discussion relating to hardship to
                  the site plan and the minimum variance required, the applicant revised his request to a 4-foot variance, thereby
                  leaving a 11-foot setback.  The Board voted to approve the 4-foot rear yard variance. 
                  

The Miami Township Board of Zoning Appeals met on Monday, May 5, 2008 to consider and take action on the following case: 

The Board set the following cases for public hearing on June 2, 2008:

        Case 802 – The applicant is requesting a side yard setback variance for an addition to a house
        at 353 Mill Street

        Case 803 - The applicant is requesting a front yard setback variance for an addition to a house
        at 5290 Sugar Camp Road

        Case 804 – The applicant is requesting a rear yard setback variance for an in-ground
        swimming pool at 958 Paxton Lake Drive.


The Miami Township Board of Zoning Appeals met on Monday, April 7, 2008 to consider and take action on the following case: 

[Case 801]  Caller Properties.  The applicant requested a variance to decrease the parking lot setback 
                  for a portion of the lot from 15 feet to 5 feet; decrease the the size of the parking stall from 
                  10 x 20 to 9.5 x 19; and to increase the permitted parking from  66 to 74 spaces.  The proposed
                  development is located on SR 28 in front of the Meijer store.  After a public hearing, the Board
                  voted to approve the variance requests.

 

The Miami Township Board of Zoning Appeals met on Monday, February 25, 2008 to consider and take action on the following cases: 

[Case 798]  KBA Incorporated.  The applicant, representing Midland Atlantic, requested a variance to permit larger
                  wall signs for the tenants of a proposed shopping center.  The request was for 2 square feet of 
                  signage for each linear foot of tenant space width.  After a public hearing the BZA voted to approve
                  the variance request.
                  

[Case 799]  Triumph Signs.  The applicant, representing Thornton's Service Station, requested a variance to permit
                  larger monument sign for their proposed gas station.  The request was for a 15.5 foot high sign at 99.6 
                  square feet.  After some discussion the the applicant amended their variance request to reflect a 
                  12.5 foot high sign at 70 square feet.  At the conclusion of the public hearing the BZA voted to 
                  approve the amended variance request.

[Case 800]  Tata Consultancy - This application was withdrawn
                 

The Miami Township Board of Zoning Appeals met on Monday, January 7, 2008 to consider and take action on the following cases: 

[Case 797]  Sharon Scovanner.  The applicant appealed a finding by the Community Development Director relating
                  Ohio Valley Voices regarding dead trees, construction debris, dead ground cover and weeds, and 
                  parking lot striping.  After a public hearing the Board voted to uphold the Community Development Director's
                  finding with regard to the dead tree, the ground cover and the parking lot striping.  The Board sustained
                  the appeal with regard to the construction debris, and the additional landscaping in the parking lot
                  island.  The Board requested the Community Development Director to address parking stops next to
                  the fence.
